Legal Support for Contractors on Renewable Energy Projects

Construction risk, in an energy context

Solar, wind and battery storage projects are construction projects. The risks you carry — time bars, liquidated damages, latent conditions, payment — are construction risks. We advise head contractors, civil and electrical contractors and specialist subcontractors on those issues.

Contract Review and Departures

Review of EPC, BOP, D&C and subcontract terms before you sign, with a schedule of departures and proposed alternate wording. We focus on liquidated damages and caps, performance guarantees, indemnities, latent conditions and pass-down of matters outside your control.

Notices, Variations and Extensions of Time

Identifying every time bar in your contract and preparing compliant notices and claims — including latent conditions, weather, access and delays caused by connection or commissioning.

Security of Payment

Payment claims, payment schedules and adjudication in each jurisdiction, together with retention, bank guarantee and set-off issues, and protection where a party upstream is in distress.

Disputes and Recovery

Adjudication, expert determination, arbitration and litigation — commonly performance liquidated damages, defects, termination and final account claims.

 Why contractors engage Kreisson

Construction lawyers with energy sector experience

Our clients choose Kreisson for clear advice, integrated expertise and a focus on practical outcomes in the renewable energy sector.

We act for the party delivering the work.

We understand how risk is passed down the contracting chain on renewable projects, and what is worth negotiating.

Construction law depth.

The same rigour we bring to AS 4000, AS 4902, GC21 and bespoke contracts, applied to unfamiliar energy structures.

Advice you can act on.

Entitlements are lost on missed notices. We work to the deadline in front of you and scale the work to what is at stake.

Frequently asked questions

We are a contractor, not a developer. Is this the right firm?

Yes. Our renewable energy work is principally for contractors and subcontractors delivering these projects.

What is different about a renewable energy contract?

The construction risk is conventional; the wrapper is not. Expect performance guarantees tied to output, liquidated damages linked to connection milestones, extended warranty regimes for plant, principal-supplied equipment, and pass-down of grid connection and planning conditions outside your control.

When should we engage you?

Before you price the work, ideally. A departures review lets you price the risks you are accepting rather than absorb them. We are also regularly engaged midstream on claims, show cause notices and payment disputes.

Does security of payment legislation apply?

Generally yes. In New South Wales, the definition of construction work in s 5 of the Building and Construction Industry Security of Payment Act 1999 (NSW) is broad enough to capture civil, structural and electrical work on solar, wind and battery projects. Each jurisdiction has its own Act, timeframes and exclusions.

Who will lead our engagement?

A senior Kreisson lawyer with construction and energy experience, supported by the wider team. You deal directly with the lawyer doing the work.

What will it cost?

We break work into defined stages, beginning with a fixed-scope engagement such as a contract review, and provide an estimate for each stage with no obligation to proceed. Any change in scope is raised before cost is incurred.
